The necklace was destroyed. Already a few episodes earlier. Damon found it and had it repaired. He gave it to Elena on her 18th birthday. That’s why I always say: please pause when you’re talking about something! Because there are so many small moments like this that become incredibly important later on — and you miss them because of that.

Damon usually goes on a spiral and kills innocent people when he's hurt and angry, which doesn't make it right, but he's always been able to control himself with blood and bodies. He also does embrace being a vampire, and part of that is hunting humans, but from what we've scene he doesn't get pleasure from killing innocent people in a normal state of mind like Stefan used to. Stefan was completely indulging in the pleasure of killing just for fun.
