Or they can do like Marvel Avengers and have them kinda look like him, but not really.

Don't know, since Arkham Knight got the Batsuit from Nolan Trilogy. and both games are under WBros... Might be cuz of Likeness of Heath Ledger. Well they would even need the likeness just the outfit would do.
