They did not explain it super well in the anime, but your theory was VERY close! All students are supplied with two school standard jackets. So, Kiyo knew that Kushida only has one uniform that she can use left because she cannot wear the uniform she made him touch in S1! If she wore that uniform, it would get dirty and she would have to wash it, which eliminates the evidence she has against him. So the uniform Kei dumped the drink on wasn't the same uniform Kiyo touched, but it was the only uniform Kushida had left! Good theory!
